TERMS AND CONDITIONS FOR TRAINING VIA THE EDUCATIONAL PLATFORM

1. GENERAL PROVISIONS
1. GENERAL PROVISIONS
1.1. These Terms and Conditions set out:
1.1.1. the type and scope of the service verifying whether the User meets the initial requirements for enrollment in the Course and for reserving a place in the Course on a date selected by the User, conducted by VizAcademy sp. z o.o. via the Platform available at: https://edu.archiacademy.co.uk
1.1.2. the type and scope of continuing education services in non-school forms provided by VizAcademy sp. z o.o. using distance learning methods and techniques via the Educational Platform available at: https://edu.archiacademy.co.uk based on the agreement for conducting the Course,
1.1.3. the conditions for providing services via the Platform and the Educational Platform, including the technical requirements necessary for proper use of the Educational Platform,
1.1.4. the terms and conditions for concluding and terminating the reservation agreement and the course agreement,
1.1.5. the rules for processing Users’ personal data,
1.1.6. the rights and obligations of Users of the Platform and the Educational Platform, including the complaint procedure.
1.2. The User is required to read these Terms and Conditions before concluding the Reservation Agreement and the Course Agreement. Acceptance of these Terms constitutes confirmation that the User understands that entering into the agreement entails an obligation to pay.
1.3. These Terms are governed by applicable law, in particular:

the Act on the Provision of Electronic Services,

the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws 2020, item 287, as amended), including the Act of 4 November 2022 amending the Act on Consumer Rights,

the Civil Code,

the Act – Private International Law (Journal of Laws 2022, item 2337, hereinafter: the “Act Amending the Act on Consumer Rights”).
2. DEFINITIONS
2.1. Business Day – a day from Monday to Friday, excluding public holidays.
2.2. Enrollment Form – a form in which the User voluntarily provides the necessary personal data and other information required to conclude a Reservation Agreement for the Course selected by the User.
2.3. Registration Form – a form in which the User voluntarily provides the necessary information required to conclude the Course Agreement.
2.4. Conferences – a training service delivered in the form of a live streaming session, enabling the User to participate in the Course remotely using technical devices allowing for the transmission of video and audio between the Instructor and the User via the internet, conducted through the Educational Platform.
2.5. User Account – an individual access panel to the Educational Platform, made available to the User after registration using a login and password created by the User.
2.6. Course – a paid 6-week continuing education service delivered by VizAcademy sp. z o.o., in accordance with the Course Curriculum approved by qualified teaching staff appropriate for the type of training provided. The Course includes Conferences, instructional recordings, educational materials, and support assistance. The service is delivered using distance learning methods and techniques via the Educational Platform. Completion and successful passing of the Course entitles the User to receive a certificate of completion.
2.7. Educational Materials – digital content created by VizAcademy sp. z o.o. in the form of assignments, graphics, and e-books. Educational Materials constitute digital content within the meaning of the Act of 30 May 2014 on Consumer Rights, and also constitute a work within the meaning of the Act of 4 February 1994 on Copyright and Related Rights, to which VizAcademy sp. z o.o. holds the copyright.
2.8. Platform – the website operated at https://edu.archiacademy.co.uk through which a place on a Course may be reserved.
2.9. Educational Platform – the online educational platform available at https://edu.archiacademy.co,uk, through which VizAcademy sp. z o.o. provides continuing education services within the framework of the Courses.
2.10. Verification Process – a service provided via the Platform consisting of checking, based on the information and declarations provided by the User in the Enrollment Form, whether the User meets the Course enrollment requirements in accordance with the Statute of VizAcademy sp. z o.o.
2.11. Reservation Agreement – an agreement for reserving a place in a Course, concluded between the User and VizAcademy sp. z o.o.
2.12. Course Agreement – an agreement covering the delivery of a training service by VizAcademy sp. z o.o. to the User in accordance with the Course Curriculum.
2.13. Training Service – a continuing education service enabling Users to acquire and update knowledge, skills, and professional qualifications, delivered by VizAcademy sp. z o.o. via the Educational Platform with the use of the internet, with varying levels of access to educational materials, functionalities, and benefits depending on the Course selected by the User. The Training Service is not an electronic service within the meaning of Article 2(26) of the VAT Act and Article 7 of Regulation 282/2011, on the basis of Article 7(1) of Council Regulation (EU) No. 282/2011 of 15 March 2011, as it is not an automated service.
2.14. User – any adult natural person with full legal capacity, a legal person, or an organisational unit without legal personality but granted legal capacity by law, who has concluded or concludes a Reservation Agreement and a Course Agreement via the Platform.
2.15. Terms and Conditions – these terms and conditions for the provision of services together with their annexes.

2.17. Support – a training service involving the provision of substantive support to Users via online communicators (e.g., Skype) by instructors of VizAcademy sp. z o.o.
2.18. VizAcademy – VIZACADEMY Non-Public Continuing Education Institution, with its registered office in Warsaw, ul. Kolejowa 47, unit U-23, 01–210 Warsaw, entered in the register of non-public schools and institutions maintained by the Capital City of Warsaw under number 1240K, operated by VIZACADEMY sp. z o.o., with its registered office in Chełmiec, ul. Rolna 23A, 33-395 Chełmiec, entered in the Register of Entrepreneurs of the National Court Register under number KRS 0000725092, REGON: 369803210, NIP: 7343557295, providing services via the Platform and the Educational Platform. 2.19. ArchiAcademy – the name of the Course related to learning the Autodesk Revit software, conducted by VizAcademy sp. z o.o.
3. RULES FOR USING THE PLATFORM
3.1. Through the Platform, the User may conclude a Reservation Agreement and a Course Agreement.
3.2. As a result of concluding the Course Agreement, the User gains the right to use the Educational Platform within the timeframe and in the variant that includes the benefits and functionalities defined for the selected Course.
3.4. Access to the Educational Platform is granted to the User after the payment referred to in point 5 of these Terms has been credited, in accordance with the selected Course. The User selects the Course at the time of enrollment, in accordance with its description and price.
3.5. Access to the Educational Platform is possible by logging in using a login and password. The User’s login is the email address provided during account creation.
3.7. Access to the training on the Educational Platform is paid and voluntary for the User.
3.8. The User is obliged to:
3.8.1. act in a manner that does not infringe the rights of other Users,
3.8.2. not share access credentials to the Educational Platform with unauthorised third parties, in particular not sharing any materials available via the Educational Platform,
3.8.3. not transfer, whether for payment or free of charge, the right to use the Educational Platform to third parties,
3.8.4. use the Educational Platform in a manner consistent with these Terms, applicable laws in Poland, social and customary norms, and general principles of internet use, including using the Educational Platform in a way that does not disrupt its functioning.
3.9. If the User engages in activities contrary to these Terms or infringing the rights of other Users, VizAcademy sp. z o.o. may notify the User of this fact by email, demanding cessation of such activities. If the User fails to comply immediately, this will be considered a breach of the Terms and may result in blocking the User’s access to the Educational Platform.
3.10. VizAcademy sp. z o.o. is not responsible for how Users use the materials provided through the Educational Platform.
3.11. In order to ensure the highest level of security and data protection for the User, VizAcademy sp. z o.o. applies modern security techniques for accounts and communications within the Educational Platform.
5. RESERVATION AGREEMENT
5.1. The condition for concluding a Reservation Agreement is acceptance of these Terms and the availability of places in the Course on the date selected by the User.
5.2. The content of the Reservation Agreement is made available to the User on the platform https://edu.archiacademy.co.uk
6. WITHDRAWAL FROM THE RESERVATION AGREEMENT
6.1. The right to withdraw from the agreement is granted exclusively to a User who has concluded an agreement with VizAcademy sp. z o.o. as a consumer, or as a natural person who has concluded an agreement related to their business activity but where it is clear from the nature of the agreement that it does not have a professional character for them, in accordance with Article 22(1) of the Civil Code, and where the non-professional character also follows from the content of the agreement in accordance with Article 7aa of the Act of 30 May 2014 on Consumer Rights.
6.2. The User may withdraw from the agreement within 14 days from its conclusion, without giving any reason.
6.3. Withdrawal from the agreement may be effected by the User by sending a withdrawal statement in writing or electronically to the email address: biuro@archiacademy.pl.
6.4. VizAcademy sp. z o.o. provides a withdrawal form template as Annex No. 1 to these Terms.
6.5. In the event of effective withdrawal from the agreement by the User, VizAcademy sp. z o.o. is obliged to promptly, and no later than within 14 days from the date of receipt of the withdrawal statement, return to the User all payments made by them.
7. COURSE AGREEMENT
7.1. VizAcademy makes the Course Agreement available on the platform https://edu.archiacademy.co.uk after the User has enrolled in a group.
7.2. Upon successful payment, a Course Agreement is concluded between the User and VizAcademy sp. z o.o. Confirmation of the agreement is the granting of full access to the student profile on the platform https://edu.archiacademy.co.uk
8. EDUCATIONAL SERVICES PROVIDED VIA THE EDUCATIONAL PLATFORM. COURSE ORGANIZATION
8.1. VizAcademy provides educational services via the Educational Platform on the dates chosen by the User at the time of concluding the Agreement and within the selected and paid Course.
8.2. Through the Educational Platform, the User has the opportunity to acquire and update knowledge, skills, and professional qualifications, or to change professional qualifications as referred to in Article 117(1a)(5) of the Education Law.
8.3. Before the start of the first Conference within the Course, VizAcademy organizes training on the teaching methods, rules, and operation of the software used.
8.4. Educational services include:
8.4.1. providing the User, depending on the selected Course, access to educational services within the scope of the Course Curriculum,
8.4.2. delivering educational materials prepared in a form suitable for distance learning, which will be available to Users on the Educational Platform and used during home study to master the Course Curriculum,
8.4.3. providing interactive assignments to Users.
8.5. The Course consists of four modules:
8.5.1. introduction to the Course subject and working methods in Autodesk Revit,
8.5.2. preparation and provision of instructional videos describing each stage of completing a given exercise, with indications of methods and techniques for its execution,
8.5.3. practical work — independent execution of the exercise and assistance provided to the User via text chat support,
8.5.4. review of the User’s homework and providing feedback for further work.
8.6. The work schedule is available on the Educational Platform. The selection of topics and materials for each Course module is at the sole discretion of VizAcademy sp. z o.o.
8.7. The Course is conducted in a form including cyclical conferences, thematically related workshops, and individual work between the instructor and the User.
8.8. The Course is held on the dates and times indicated by VizAcademy sp. z o.o.
8.9. During each Conference, VizAcademy sp. z o.o. will provide the User with an assignment and corresponding instructional videos.
8.10. VizAcademy sp. z o.o. reserves the right to freely appoint the instructor.
8.11. Participation in the Course requires a computer with the necessary software and internet access.
8.12. VizAcademy sp. z o.o. does not provide the User with software, computer, or any technical means to participate in the Course — all such requirements are the responsibility of the User.
8.13. The User receives instructional materials during the Course, which they are responsible for storing and securing on their own devices. VizAcademy sp. z o.o. is not liable for loss of such data, for inappropriate configuration or installed software on the User’s computer, or for poor internet quality. For clarity, VizAcademy sp. z o.o. is not responsible if the User misses part or all of the Course due to equipment issues, nor for engaging with course content (tasks, videos, or conferences) in inappropriate conditions (e.g., while driving, walking, cycling, etc.).
8.15. Support is provided only via the platform specified by VizAcademy sp. z o.o. on the Educational Platform https://edu.archiacademy.co.uk— in a group chat belonging to the group to which the User applied. The support period lasts for 6 weeks from the start of the first Conference.
8.16. The person providing support may direct the User to re-watch certain instructional materials if the User has not previously done so or if their knowledge clearly indicates they have missed content covered in those materials.
9. COURSE PROGRESS. ONGOING MONITORING OF USERS’ LEARNING PROGRESS, VERIFICATION OF THEIR KNOWLEDGE, SKILLS, AND COMPETENCES
9.1. In the event of complete inactivity by the User in the Course, VizAcademy sp. z o.o. has the right to remove the User from the Course (provided that at least one reminder has been sent to the User about their obligation to actively participate), with a refund of the fee already paid, reduced proportionally to the number of instructional materials and knowledge already provided. The final refund amount is determined by VizAcademy sp. z o.o.
9.2. The User is obliged to promptly inform the Course Organizer (ArchiAcademy) if, for personal reasons, they are unable to attend classes or complete homework. In such a case (unless otherwise agreed separately), the User is entitled to a refund reduced proportionally to the number of instructional materials and knowledge already provided, provided that the User notifies VizAcademy sp. z o.o. no later than on the 20th day of the Course. The final refund amount is determined by VizAcademy sp. z o.o. No further instructional materials will be sent to the User.
9.3. If, for personal reasons, the User is unable to attend classes or complete homework but has not informed the Organizer (ArchiAcademy) by the 20th day of the Course in accordance with point 9.2, VizAcademy sp. z o.o. will not stop sending instructional materials (provided all outstanding payments are made on time). In this case, the User is not entitled to any refund and must pay any remaining Course fees by the agreed deadlines.
9.4. The User must send proof of payment by email before the Course begins (in the case of one-off payments). For installment payments, the User must provide proof of each payment by the agreed deadline.
10. COURSE CANCELLATION
10.1. VizAcademy sp. z o.o. reserves the right to cancel or unilaterally change the Course date:
10.1.1. due to force majeure (at any time),
10.1.2. up to 3 days before the start of the Course in the event of an insufficient minimum number of enrolled Users, with the minimum number determined by VizAcademy sp. z o.o. for each Course.
10.2. If the User withdraws from participation in the Course up to 7 days before the start of the first class, they are entitled to participate in the next edition of the Course of their choice with priority reservation.
10.3. Neither party shall be liable for non-performance or improper performance of the Course Agreement if caused by force majeure, i.e., extraordinary, unforeseeable, and unavoidable circumstances despite reasonable foresight, including natural disasters, catastrophes, strikes, riots, etc.
10.4. Deadlines for fulfilling obligations under the Course Agreement shall be extended by the duration of the force majeure.
10.5. The party invoking force majeure must promptly notify the other party of its occurrence and its impact on timely and proper performance of the Agreement.
11. REMUNERATION
11.1. The amount of remuneration due to VizAcademy sp. z o.o. for organizing and conducting the Course depends on the Course selected by the User at the time of concluding the Reservation Agreement and the Course Agreement.
11.2. Payment is made in advance, before access to the Educational Platform is granted, using one of the following available methods:
11.2.1. via a payment operator providing payment services within the meaning of the Act of 19 August 2011 on Payment Services,
11.2.2. by bank transfer to the account of VizAcademy sp. z o.o., or via the Stripe platform.
11.3. The price is given in gross (inclusive of tax) amounts.
11.4. If a reduced price is offered, VizAcademy sp. z o.o. will also display the information about the lowest price that applied within the 30 days prior to the reduction, or from the day the Course was first offered (if shorter than 30 days), or the price prior to the reduction.
12. TECHNICAL REQUIREMENTS
12.1. Computer with monitor, mouse, and keyboard.
12.2. Internet access.
12.3. Minimum computer requirements: Intel i5 or AMD Ryzen 5 processor, 8GB RAM, system drive with at least 50GB of available free space.
13. PERSONAL DATA
13.1. Under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: “GDPR”), we inform that the controller of personal data collected during Course enrollment is VizAcademy sp. z o.o.
13.2. Detailed information on the processing of personal data is included in the Privacy Policy.
13.3. VizAcademy sp. z o.o. processes personal data for the purposes of:
13.3.1. processing enrollment and delivering the Course (Article 6(1)(b) GDPR),
13.3.2. fulfilling its legal obligations (Article 6(1)(c) GDPR),
13.3.3. establishing or defending legal claims (Article 6(1)(f) GDPR), and
13.3.4. marketing its own services (Article 6(1)(f) GDPR if we are in a contractual relationship, and Article 6(1)(a) GDPR in other cases, where consent has been given).
13.4. Consent given may be withdrawn at any time.
13.5. Course Users may not copy, reproduce, or take screenshots containing personal data of other Course participants or their displayed/discussed work.

14. COPYRIGHT PROTECTION
14.1. Texts, graphics, diagrams, photographs, sounds, presentations, videos, and all other materials available on the Educational Platform, including Educational Materials, are protected by copyright as works within the meaning of Article 1(1) of the Act on Copyright and Related Rights (consolidated text: Journal of Laws 2022, item 2509, as amended).
14.2. Materials available on the Educational Platform are not in tangible form and are not placed on the market as such. The User may not share the materials with third parties, including close family members, whether for payment or free of charge.
14.3. VizAcademy sp. z o.o. grants the User a non-exclusive, non-commercial license to use the materials available on the Educational Platform, in accordance with the terms described in this §14.
14.4. The non-commercial license allows the User to use the materials solely for their own internal purposes, without the right to sell (resell), rent, lease, sublicense, or otherwise provide them to third parties (whether for payment or free of charge).
14.5. Under the license, the User may: display, play, print, and store materials on their own devices (including RAM) or server, strictly for personal use.
14.6. The User may not in any way distribute or share the acquired materials, modify their content or appearance, in whole or in part, create derivative works, or otherwise alter them.
14.7. License rights apply exclusively to Users (natural persons) who have entered into a Course Agreement. Use of the materials in breach of this license (e.g., by sharing with others) may result in civil and criminal liability.
14.8. The license does not grant the right to grant further licenses (sublicenses) unless VizAcademy sp. z o.o. has given explicit written consent. Such consent may be subject to additional conditions.
14.9. Materials may be protected against unlawful copying. Information about such protection will be provided in their description. The User may not remove or alter these protections.
14.10. VizAcademy sp. z o.o. reserves the right to audit the User’s use of materials. The audit rights include, in particular, the right to request information and explanations regarding use, without revealing VizAcademy’s identity or indicating that the purchase (or attempted purchase) by a third party is at VizAcademy’s request.
14.11. In case of doubts about the permitted scope of use, or interest in commercial use or resale, the User should contact: biuro@3dvizacademy.com.
15. REQUEST TO BRING THE USE OF THE EDUCATIONAL PLATFORM INTO COMPLIANCE WITH THE AGREEMENT
15.1. If the educational services provided via the Educational Platform are not in conformity with the Course Agreement, the User may request that the Educational Platform be brought into conformity with the agreement.
15.2. VizAcademy sp. z o.o. may refuse to bring the Educational Platform into conformity with the Course Agreement if it is impossible to do so or would require excessive costs.
15.3. In assessing the excessiveness of costs for VizAcademy sp. z o.o., all circumstances of the case shall be taken into account, in particular the significance of the lack of conformity and the value of the Educational Platform in conformity with the Course Agreement.
15.4. VizAcademy sp. z o.o. shall bring the Educational Platform into conformity with the agreement within a reasonable time from being informed by the User of the lack of conformity, and without undue inconvenience to the User, taking into account the nature and purpose of its use. The costs of bringing the Educational Platform into conformity shall be borne by VizAcademy sp. z o.o.
16. STATEMENT ON PRICE REDUCTION OR WITHDRAWAL FROM THE COURSE AGREEMENT
16.1. If the educational services provided via the Educational Platform are not in conformity with the Course Agreement, the User may submit a statement to reduce the remuneration (as per §11) or withdraw from the agreement if:
16.1.1. bringing the Educational Platform into conformity with the Course Agreement is impossible or would require excessive costs in accordance with §15.2 and §15.3,
16.1.2. VizAcademy sp. z o.o. has not brought the Educational Platform into conformity as per §15.4,
16.1.3. the lack of conformity persists despite measures taken by VizAcademy sp. z o.o.,
16.1.4. the lack of conformity is significant enough to justify a reduction in price or withdrawal without first using the remedy described in §15,
16.1.5. it is clear from the statement of VizAcademy sp. z o.o. or the circumstances that it will not bring the Educational Platform into conformity within a reasonable time or without undue inconvenience to the User.
16.2. The reduced remuneration must be proportionate to the difference in value between the Educational Platform in non-conformity and the Educational Platform in conformity with the Course Agreement, taking into account the duration of the lack of conformity.
17. COMPLAINTS AND INQUIRIES
17.1. If the User has any doubts or problems related to the use of VizAcademy sp. z o.o. services, they may contact VizAcademy sp. z o.o. by email at: biuro@3dvizacademy.com.
17.2. Every User has the right to submit a complaint regarding the functioning of the Educational Platform.
17.3. Complaints may be submitted by email to: biuro@3dvizacademy.com.
17.4. The complaint should include the User’s name, surname, mailing address, a description of the action or omission being complained about, and the User’s request regarding the complaint.
17.5. VizAcademy sp. z o.o. will process the complaint within no more than 14 days from receipt. Processing means sending a response indicating whether the complaint is upheld or rejected.
17.6. Submitting a complaint and its rejection or lack of consideration by VizAcademy sp. z o.o. does not affect the User’s right to pursue claims through judicial or out-of-court means, in accordance with applicable law.
18. OUT-OF-COURT COMPLAINT RESOLUTION AND CLAIMS
18.1. The provisions of §17 do not exclude the User’s right to pursue claims under applicable law. The User may use out-of-court complaint resolution and claim procedures as described on the Office of Competition and Consumer Protection website at: https://www.uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php.
18.2. In particular, the User may apply:
18.2.1. to a permanent consumer arbitration court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection, with a request to resolve a dispute arising from the agreement,
18.2.2. to the provincial trade inspector, in accordance with Article 36 of the same Act, with a request to initiate mediation proceedings for an amicable settlement,
18.2.3. to the county (municipal) consumer ombudsman or a consumer protection organization (e.g., the Consumer Federation, Consumers’ Association).
18.3. At https://www.ec.europa.eu/consumers/odr there is an online dispute resolution platform for consumers and traders at EU level (ODR platform), providing an interactive, multilingual one-stop-shop for resolving disputes out of court regarding contractual obligations from online sales or service agreements.
19. AMENDMENT OF THE TERMS AND CONDITIONS
19.1. These Terms and Conditions may be amended, in particular, in the event of:
19.1.1. changes to applicable laws affecting the content of the Terms,
19.1.2. changes in the scope of services provided,
19.1.3. changes in the type of services provided,
19.1.4. changes to the technical requirements necessary for proper use of the Educational Platform.
19.2. Each amendment to the Terms will be announced by posting the consolidated text of the amended Terms on the Platform and the Educational Platform.
19.3. The new text of the Terms will be delivered to the User by sending them a link to the webpage with the updated Terms to the email address provided during enrollment.
19.4. The amended Terms shall enter into force 14 days after being announced and sent to the User.
19.5. A User who does not agree to the amendment of the Terms may resign from further use by submitting a termination notice within 7 days from the date the notice of the amendment was sent.
20. FINAL PROVISIONS
20.1. All information about violations of these Terms by Users should be sent to: biuro@3dvizacademy.com.
20.2. The agreement may only be concluded in the Polish language.
20.3. In matters not regulated by these Terms, the relevant provisions of Polish law shall apply.
20.4. These Terms and Conditions are effective as of 22 May 2024.

In accordance with Article 6(1) of the Act of 18 July 2002 on the Provision of Electronic Services (consolidated text: Journal of Laws 2020, item 344), VizAcademy sp. z o.o. informs about specific risks that may be associated with the use of services provided electronically. This information covers potential threats that should be taken into account, even though VizAcademy applies security measures to protect against unauthorised actions by third parties.
The main risks associated with using the Educational Platform via the internet include:

malicious software;

various applications or scripts with harmful, criminal, or malicious effects on the IT system used by the User, such as viruses, worms, trojans, keyloggers, dialers;

spyware;

tracking programs collecting and sending information about the User without their knowledge or consent;

spam — unsolicited electronic messages sent to multiple recipients, often containing advertising content;

phishing — obtaining confidential personal information (e.g., passwords) by impersonating a trusted person or institution;

hacking attacks on the User’s IT system using tools such as exploits and rootkits.
To minimise these risks, the User should install and regularly update antivirus software on their computer or device used for accessing the Educational Platform.
Additional protection measures include:

enabling a firewall,

updating all software used by the operating system or other programs,

avoiding opening email attachments from unknown senders,
-
reviewing the contents of installation windows and licenses before installing applications,

not sharing passwords or access data with unknown persons,
-
performing regular full system scans,
-
using a VPN service,
-
using original, legally sourced operating systems and applications.
